Mr. Blackburn brings over two decades of experience in crafting and implementing IP strategies that are integral to clients’ businesses. He is comfortable with the complex interplay among IP rights, regulatory issues, and market realities faced by pharma and biotechnology companies where they compete - globally.

While most large multinational companies have in-house counsel with global IP competence, it remains difficult for others to obtain such informed advice. Outside counsel’s in-depth expertise is commonly in their home country or region. There are fundamental differences in IP systems around the world, however, particularly in pharma and biotechnology. These differences create both pitfalls and opportunities. Copying in foreign countries a strategy developed for the client’s home country is potentially suboptimal. Typically working with the client’s existing patent counsel, Mr. Blackburn provides the global expertise in customizing strategies usually  available to only large multinational companies.

Global strategies require objectively weighing one country’s IP system versus another’s, for example, when selecting forum countries for oppositions or litigation. Other country-specific issues, such as market conditions and regulatory requirements, can significantly affect choices.  Mr. Blackburn’s experience compliments local counsel’s expertise when making such determinations.

The greatest stratgey in the world is useless, however, if implentation at a tactical level is not well done.  In addition to broad global strategic experience, Mr. Blackburn has substantial experience in implementing strategies at the tactical level.  He can provide experienced, creative and independent management of patent prosecution, licensing and litigation.  In addition to bringing a track record of tactical success to  a cleint's matter, Mr. Blackburn can keep individual initiatives in sync with the cleint's overall stratgey.
